Purchasing and Delivery Terms
1. MINIMUM AGE AND LEGAL CAPACITY
Purchasing products or services on this website is restricted to individuals 18 years of age or older.
WARNING – It is against the law to sell or supply alcohol to, or to obtain alcohol on behalf of, a person under the age of 18 years. All customers must be 18 years or older to purchase products through our online store.
By purchasing through our online store you acknowledge you are 18 years or older and if asked, at the time of delivery, will be able to produce suitable identification.
Should Tallagandra Hill suffer any loss or damage as a result of a transaction entered into by a minor, Tallagandra Hill reserves the right to seek compensation for such losses from the parents or guardians of the minor who caused the order to be placed.
2. ACCURACY OF PRODUCT DESCRIPTION
All products and services listed on this website are described to the best of our abilities and using the information available to us at the time. Care is taken to ensure that this information is correct, but we cannot eliminate the possibility of:
- Human error in entry of information
- Incorrect information provided to us by suppliers or distributors
- Failure of suppliers or distributors to supply updated information to us
We reserve the right to change any information including but not limited to pricing, specifications, descriptions, or product names without notice.
All orders on this website must be pre-paid before fulfilment. All orders are placed in Australian dollars.
In the case that you pay for an order with your credit card, we do not store your credit card number on our servers, however it may be retained by our payment gateway provider in circumstances where this is required.
In the case of offline payment, we will contact you to arrange payment. This process must be completed before your order can ship.
In cases where your payment for an order fails for reasons including but not limited to insufficient card credit, or cheque dishonour, we do not warrant that stock will be held until an alternate payment method is available or the original payment method made to function.
4. PRICES AND TAXES
Prices are displayed to Australian visitors of this website (unless otherwise marked) including GST if applicable to the product, and in Australian Dollars.
If we determine that you are in a foreign country, we may display prices to you without GST and/or in alternate currencies.
Tallagandra Hill supports the responsible service of alcohol. It is against the law to sell or supply alcohol to, or to obtain alcohol on behalf of, a person under the age of 18 years. You can purchase Tallagandra Hill products online or over the phone and have your order delivered to your home or office. Due to Licensing Laws you must be over 18 years of age in order to place and receive a delivery. Tallagandra Hill may ask you to provide additional details or require you to confirm your details to enable us to process any orders placed through the Site.
Tallagandra Hill delivery partner is Australia POST. If you are not at home at the time of delivery, an “Article Awaiting” card will be left in your mailbox and your order will be automatically delivered to the nearest Post Office. Your order will not be left at unattended premises, nor will they be left with persons under the age of 18 years (proof of age may be required).
Registered customers may request for their delivery to be left unattended, however, Australia POST reserves the right to leave a call waiting card regardless of this request. Australia POST highlights the following examples of where a call waiting card will be left regardless of an authority to leave request:
- There was no one in attendance and no clear delivery instruction authorising us to leave the parcel in a safe place
- Somebody was at home but they could not provide proof of age
- There was an authority to leave (and no one answered the door), but the driver was concerned that minors were present within the vicinity of the premises (e.g. children playing inside or outside of the house)
Orders are despatched Monday to Friday. If there is available stock of your items at time of picking, Tallagandra Hill will aim to dispatch your order within Five (5) business days. Tallagandra Hill cannot guarantee or provide a day of the week or time of day for delivery.
Tallagandra Hill reserves the right to limit the number of products purchased to retail quantity limits.
Tallagandra Hill is not liable for any loss, damage or delay occasioned to you or any other person claiming through you arising from late or non-delivery of the wine ordered.
In the event that you receive a product that appears to have been damaged in transit you should:
- Refuse to accept delivery of the product.
- Direct the Courier to Return Goods to Sender.
- Notify our Cellar Door Staff immediately. Please contact: 02 62368694
If you have already accepted delivery, and then notice that the product appears to have been damaged during transit you should notify Tallagandra Hill immediately, so the return can be processed as “Damaged in Transit”.
6. RETURN POLICY
In the case of purchase of a physical product from this website which satisfies one or more of the following cases we will gladly arrange a refund or exchange of the product:
- The product proves faulty within 14 days of receiving the product and/or date of invoice
- The product does not match its description as provided when sold
- The product received is not the product ordered
- The product has been damaged in transit
Please contact us immediately if any of the above occurs to arrange a return. Products returned without prior notice will be rejected.
Please ensure that returned products are safely packed in their original packaging. We will not be held liable for damage to products incurred during return shipping.
7. TAX INVOICE
Upon completion of your order, we will supply a Tax Invoice to you in the form of an email. Please ensure that the email address you have provided us is correct.
We use industry-standard SSL encryption where applicable to protect the privacy of information in transit between this website, yourself, and our suppliers including payment gateways.
You acknowledge that the security of communications sent by electronic means cannot be guaranteed. You provide information to us via the internet at your own risk. We cannot accept responsibility for misuse or loss of, or unauthorised access to, your personal information where the security of information is not wholly within our control.
9. LIMITATION OF LIABILITY
Nothing in this Contract is to be interpreted as having the effect of excluding, restricting or modifying any condition or warranty, or right or liability implied by any applicable legislation into the arrangement between Tallagandra Hill and you, if such exclusion, restriction or modification would be void or prohibited by the legislation. To the extent that Tallagandra Hill breaches any condition or warranty implied into the arrangement between Tallagandra Hill and you and which cannot be excluded or modified, Tallagandra Hill’s liability is limited to, at Tallagandra Hill’s discretion, either: (i) replacement of the goods or supply of equivalent goods; (ii) payment of the cost of replacing the goods or acquiring equivalent goods; and in the case of services, to: (i) supply of the services again; or (ii) payment of the cost of having the services supplied again.
Subject to the foregoing, Tallagandra Hill is not liable to you (or to any third party claiming through you) for, and you release Tallagandra Hill from, any loss, liability, damage, expense or cost whatsoever and includes (without limitation) indirect or consequential loss or damage, loss of profits or business opportunity, and damage to equipment or property (“Loss”) caused by any act or omission of Tallagandra Hill, its employees or agent, and whether based on negligence or other tort, contract or otherwise.
